1. About First Caption

First Caption is a Brand Architecture consultancy based in Barbados, offering brand strategy, social media management, and brand building services. All services are provided by First Caption ("we", "us", "our"). The client engaging our services is referred to as "you" or "the client".

2. Services

We offer the following core services. Each is governed by a separate service agreement which outlines the full scope, deliverables, and timeline.

Any work outside the agreed scope of a service will be discussed and priced separately before it begins.

3. Bookings and Payment

All bookings are confirmed upon receipt of full payment unless otherwise agreed in writing. Payments are processed securely through PayPal or through HoneyBook, depending on the service. By completing payment, you confirm your intent to proceed with the booked service.

Prices are listed in the currency stated at the time of booking. First Caption reserves the right to update pricing at any time. Changes will not affect confirmed bookings.

4. Cancellations and Refunds

Cancellation and refund terms are outlined in the service agreement for each individual service. Terms may vary depending on the service, the contract, and the deliverables involved. Please review your service agreement carefully.

To ensure the best outcome from our services, clients are expected to:

• Provide accurate and complete information about their business when requested
• Respond to communications in a timely manner to avoid delays
• Attend scheduled sessions at the agreed time
• Provide feedback and approvals within agreed timeframes where applicable

Delays caused by the client may affect delivery timelines. First Caption will not be held responsible for delays resulting from late or incomplete client input.

6. Intellectual Property

All strategy documents, written summaries, creative assets, and deliverables produced by First Caption remain our intellectual property until full payment has been received. Upon receipt of full payment, ownership of agreed deliverables transfers to the client.

First Caption reserves the right to reference completed work in our portfolio and marketing materials unless the client requests otherwise in writing.

7. Confidentiality

We treat all client information with discretion. Any sensitive business information shared with us in the course of our services will not be disclosed to third parties without your consent, except where required by law.

8. Limitation of Liability

First Caption provides brand strategy and consultancy services in good faith based on the information available. We cannot guarantee specific business outcomes or results. Our liability is limited to the amount paid for the specific service in question.

9. Governing Law

These Terms and Conditions are governed by the laws of Barbados. Any disputes arising from our services will be subject to the jurisdiction of the courts of Barbados.

10. Changes to These Terms

First Caption reserves the right to update these Terms and Conditions at any time. The most current version will always be available on our website. Continued use of our services after any changes constitutes your acceptance of the updated terms.
